Francis Hutcheson on the laws of war

The article discusses Hutcheson’s views on the legal regulation of war. These views should be situated within the broader context of Hutcheson’s complex and ambiguous moral philosophy. For this reason, the work presents the concept of the moral sense as the thinker's original contribution to the field of moral philosophy, as well as the position of the concept of natural law in his thought. An essential background for the analysis is also provided by the views of authors who inspired Hutcheson and who dealt directly with the issue of war, namely, representatives of the modern natural law doctrine: Grotius, Pufendorf, and the translator of the latter’s works, Gershom Carmichael. In the conclusion, the paper addresses the relevance of the individual elements of Hutcheson’s thought (the category of the moral sense and the concept of natural law) in relation to the problem of war.
